Alphabet Statutes

There are two specific statutes that govern the way in which interstate child support and child custody matters are handled. They are referred to as the "alphabet statutes" and are listed below.

Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA)

The UCCJEA was enacted by 48 states and the District of Columbia to govern interstate child custody matters. The act creates exclusive continuing jurisdiction (ECJ) for child custody matters with the child's home state, if the child or one of the parties remains in the original state where the order was issued. The state with continuing jurisdiction may decline to exercise jurisdiction based upon a number of factors. The UCCJEA defines a child's home state as the state where the child has lived with the custodial parent for six consecutive months before the child custody case was filed. If a child has not lived in a state for at least six months, the court of a state that has significant connections with the child can assume jurisdiction.

The UCCJEA has additional requirements that apply for interstate child custody cases. I have extensive experience handling cases applying the UCCJEA in New York and outside the state for New York residents.

Uniform Interstate Family Support Act (UIFSA)

Adopted by every U.S. state, the UIFSA addresses the non-payment of child support and limit or establish the exercise of long-arm jurisdiction by courts to create or modify child support orders. When more than one state is involved in establishing, enforcing or modifying a child support (or spousal support) order, this act is applied to determine which state holds jurisdiction. This prevents parents from moving merely to avoid paying their child support obligation; it also prevents forum shopping by a party attempting to obtain a better "deal" by moving to another state.

The statute is complex, comprising over 60 sections of the New York statutes. Case law interpreting these statutes creates another layer of analysis. Because the UIFSA implicates issues of long-arm jurisdiction with interstate child support and custody cases, you want an experienced attorney to help determine how best to proceed with you case based on your facts.
