My Experience and Commitment to New York Family Law

Since 1979, the New York family law office of Barton R. Resnicoff, Attorney at Law, has been committed to providing effective, quality legal representation for residents living in communities throughout Long Island, New York.

When I first started practicing law, I practiced with two very different partners, from whom I learned different things. From one partner, I learned how to practice tough and give no quarter. From the other, I learned how to use the law to assist my client; how to work with the parties and the other attorney to resolve the case fairly. I have always been very strong in dealing with the facts and the personalities of the parties. Over the years, despite no formal training, based upon working with and contact with professionals in the accounting and mental health fields, I have mastered the principals in those fields as it applies to matrimonial law.

The key acknowledgment of my practice was in May 1996, when the National Board of Trial Advocacy certified me as a Family Law Trial Specialist.* I was recertified as a specialist in 2001. The National Board of Trial Advocacy was founded to establish objective standards to measure experience and expertise. It requires an exhaustive screening of credentials including documentation of experience, judicial and peer references and an exam. In addition to my board certification, I have also handled a significant number of appeals and have over twenty five reported decisions from these appeals. I have tried, to conclusion, over 200 matters.

I have also been engaged in various Bar Associations and especially their Matrimonial and Family Law Sections and/or Committees. During my thirty years plus as a member, I have served as Chair of the Family Law Committee of the Queens County Bar Association; I am assisting the current Chair by being in charge of pending legislation and have served as the liaison with the Judiciary Committee. I have also been active with the Community and Public Relations Committee

I have been part of numerous lectures given by the Queens County Bar Association on Matrimonial and Family Law matters, starting in 1983 to the present, topics including modification of support; the role of marital fault; possible increases to separate property; temporary support applications; and changes in the law as concerns income deduction orders. I have also written articles for the Queens Bar Bulletin on father's rights for out of wedlock children.

In over twenty years of being a member of the Matrimonial and Family Law Committees of the Nassau County Bar Association, I served for two years as co-chair of the custody sub-committee and served on the legislative sub-committee. In addition to presentations for luncheon meetings of the custody sub-committee, I also was part of presentations on Parental Alienation Syndrome; child abuse allegations and custody cases; and the role of the Law Guardian. I wrote a guide on grounds for divorce for the Nassau Attorney, the association's publication.

For the Family Law Section of the American Bar Association, I am a member of the Council, its governing body, and a member of the committee that assists the other committees with their functions; was either chair or co-chair of the Marital Property Committee for a total of four years and co-chair or vice chair of the Child Support Committee for over three years. I am also active in the Custody and Alimony committees, as well. I have, since 1992, made presentations to the section on visitation modification; the best interests of the child; Imputed income (twice); third party practice; computer tips; comparative alimony laws; using tax returns to locate hidden income and assets; comparative marital property distribution; the effect of property distribution of awards of alimony; when marital property stops accruing and factors in determining if paternity can be contested. I am also a co-author of a chapter ofa book on reading tax returns.

I have been a lecturer at Hofstra University on post divorce problems; taught part of a paralegal course on marital law; and to various local groups on matrimonial law.

I also have written for the New York State Bar Association, having already published three articles for the Family Law Review, including one on the role of the child's attorney and another on college expenses of children of divorce.

I am a divorced father with a grown daughter. I have been remarried for over fifteen years and have two stepsons in their thirties with two grandchildren. Having gone through the divorce process on a personal level, as well as having two stepchildren, I feel, has been very important in teaching me how to understand the process from the client's viewpoint and being familiar with some of the personal problems that divorce and post divorce living can present to clients and potential clients.

Over the years, I have also served as an Officer on a couple of homeowners' associations. I have also been and remain active athletically. I was on my high school and college swim team(also water polo in college). Since then, I have completed at least ten marathons (more than twenty-six miles), in addition to numerous shorter races. I had also played on two softball teams (at over fifty years of age, one of the oldest team members), making reasonable contributions to its successes; play paddleball and continue to swim whenever possible.
